Terms and Conditions for Sale of Products and Services

By placing an order for products or services from this website, you accept and are bound by these terms and conditions. You affirm that if you place an order on behalf of an organization or company, you have the legal authority to bind such organization or company to these terms. You may not order or obtain products or services from this website if you (i) do not agree to these terms, (ii) are not at least 18 years of age and legally able to form a binding contract with Element Commercial Doors LLC, or (iii) are prohibited from accessing or using this website or any of this website’s contents, products, or services by applicable law.
These terms and conditions (these “Terms”) apply to the purchase and sale of products and services through this website (the “Site”). These Terms are subject to change by Element Commercial Doors LLC (referred to as “Element,” “we,” “our,” or “us” as the context may require) without prior written notice at any time, in our sole discretion. The latest version of these Terms will be posted on this Site, and you should review these Terms before purchasing any product or services that are available through this Site. Your continued use of this Site after a posted change in these Terms will constitute your acceptance of and agreement to such changes.
1. Order Acceptance
Your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us, or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after sending you a confirmation email with your order number and details.
2. Order Cancellation and Change Orders
You may cancel or change your order within 30 days of placing it by contacting our customer service team.
Orders already customized, expedited, or in production cannot be cancelled without our written consent.
If approved, cancellations after 24 hours will incur a 10% cancellation and restocking fee plus applicable processing fees for new products only apply if it is in the exact same unused condition.
Approved changes after 24 hours will incur up to 100% change fee for materials already pulled or prepared.
Any permitted change or cancellation may result in rescheduling of your order.
3. Prices and Payment Terms
All prices posted on the Site are subject to change without notice.
Prices in effect at the time of order will apply and will be confirmed in your order acknowledgement.
Posted prices do not include shipping, handling, or taxes, which will be added at checkout.
We accept credit cards, ACH, and other approved payment methods.
You represent that all payment information provided is accurate, authorized, and valid.
4. Shipments; Delivery; Title and Risk of Loss
We arrange shipment of products; delivery dates are estimates only.
Title and risk of loss pass to you once products are transferred to the carrier.
Tailgate delivery is standard. Inside delivery is not available.
Customers must coordinate delivery appointments with the carrier. Missed appointments may incur storage fees.
5. Pick-Up Orders
If you elect to pick up products, you must do so within one week of the ready date.
Orders not collected will accrue storage fees of $100 per business day, payable before release.
Title and risk of loss pass to you upon pick-up.
6. Inspection and Acceptance
Products must be inspected upon delivery in the presence of the driver.
Any damages must be noted on the bill of lading and reported with photos to our customer service team within 24 hours.
Missing or incorrect items must be reported within 30 days.
Failure to follow these requirements constitutes acceptance of products.
7. Returns
Returns are accepted for both defective and non-defective products within 30 days of purchase, provided the item is in new and original condition. A 10% restocking fee will apply to all returns.
Once your return has been approved, you may either: Drop off the product at our Seattle warehouse, or ship it back to us at your own expense (shipping costs are the responsibility of the customer).
Minor scratches or cosmetic imperfections are not considered defects, as doors and frames ship unfinished.
8. Product Descriptions & Colors
We strive for accuracy, but actual product colors may vary depending on monitor settings. We cannot guarantee exact color fidelity.
9. Warranties
All warranties are provided solely by the manufacturer of the product. Element provides no additional warranties, express or implied, including merchantability, fitness for purpose, or title.
10. Limitation of Liability
To the fullest extent permitted by law, Element shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, use, or value. Our total liability shall not exceed the purchase price paid by you for the products or services.
11. Non-Retail Buyers
If you purchase for resale or business purposes, you represent that:
You are licensed and qualified in your jurisdiction.
You will perform all obligations in compliance with laws and standards.
You will indemnify and defend Element against any claims arising from your misuse, installation, or misrepresentation of products.
12. Goods Not for Export
Products sold are for use and delivery within the United States only.
13. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including natural disasters, strikes, epidemics, supply shortages, government actions, or transport disruptions.
14. Governing Law; Jurisdiction
These Terms shall be governed by the laws of the State of Washington. Exclusive jurisdiction lies with the state and federal courts located in King County, Washington.
15. Miscellaneous
Jury Trial Waiver: Both parties waive the right to a jury trial.
Assignment: You may not assign these Terms without our written consent.
Notices: To Element Commercial Doors, notices must be sent to our business address listed on the Site.
Severability: If any provision is invalid, the rest remain enforceable.
Entire Agreement: These Terms and accepted orders represent the final agreement between you and Element.
Relationship: We are independent contractors. You may not bind us to any commitments.
